Commission Terms of Service

If you are commissioning me you are agreeing to the following

Definitions- Any usage of first person in these terms such as "I, Me, My, Mine, etc." refers to the artist who creates the commissioned piece for the client. For exact details of the full legal business name and name of the business owner, please contact [email protected]. The full legal business name and name of the business owner will not be posted publicly on this site in order to protect the privacy of the business owner.- Any usage of second person in these terms such as "You, Your, Yours, etc." refers to the client as the person purchasing the commission.General Terms- By commissioning me that means you have read, understand, and agree to these terms of service.- Commission Terms of Service as published on this site are subject to change.- Commission prices as published on this site are subject to change.- Any changes in Terms of Service or pricing will be notified to the client before they purchase a commission- The most recent terms of service the client agreed to at the time of commissioning will continue to apply to the client and all the commissioned work the client has received in the past by the artist until the client agrees to new terms.- Clients must agree to current terms of service in order to purchase a new commission.- Any statement can be bound to change if discussed with the artist prior to the commission with recorded documentation.Payment- I only accept USD via Ko-fi or emailed invoice.- Commission costs will be as listed on this website.- All commissions must be paid in full before any work on a project begins.- The artist will confirm with the client if sufficient payment has been received and work has begun.Information and Privacy- The client must provide any requested information to the best of their abilities.- Before any payment is sent or work is begun, the client is required to state to the artist if their commission is for the commercial purposes of any business that is not a sole proprietor or individual.- At any time before the work is finished, the client must provide any artistic references as requested by the artist to the best of their ability, work on the commission will not progress until proper references are received by the artist.- Before any work has begun, if the client chooses so, they may request for any part of their commission to not be shared publicly until the commission is considered finished.- Once the commission is considered finished, the artist may publicly share the entirety of the artwork, including all work done in the processes of creating it, however the artist chooses.- Private Information such as phone numbers, email addresses, financial data (excluding commission purchasing cost amounts), photos of faces, locations, and/or birthdays, the client shares with the artist for the purpose of business will not be shared publicly online.- The artist will confirm with the client if sufficient information and reference has been received and work has begun.Waitlist- If there is a waitlist to request commissioned artwork, the artist will communicate this with the client as early as possible during negotiation.- The waitlist is a part of the progress tracking for commissions and is made public on Trello.- The artist will contact the client if they are next in line in the waitlist, when information/reference is required, when payment is due, and when work can begin on their project.- The original agreed upon price of the project at the time the client is put on the waitlist/queue will remain the same price they will be requested to pay once their project is taken on, regardless of any changes published price on this website.- The client must agree to the most recent terms of service before any payment is made, regardless of how long they have been on the waitlist.Time Frame- Time frames or due dates, must be communicated clearly by the client as early as possible in the commission process, preferably at the time the commission is being requested.- If a commission needs to be done within two weeks or less of the initial commission request, rush fees may apply.- Rush fees are negotiated between the artist and the client depending on the complexity of commission, the exact timeframe, and the artist’s availability.- If a commission does not need to be done by any specific day and there is no rush for the work to be finished, the artist will work at their own pace and around the artist’s availability.- The artist is not responsible for any potential work time lost between when the artist requests information from the client and when the client provides the information, as work cannot continue until all information requested is received by the artist.Work in Progress/Progress Tracking- Progress tracking for all commissions is made public and is updated in real time. Progress can be viewed via Trello.- A button to the Trello page can be found on the commissions page of this site. The link to the Trello is: https://trello.com/b/PC4J5vVJ/notsokatt-commissions-queue- Progress tracking includes the name or alias of the client, the type of commission, cost of the commission, time the artist spent on the commission, the start date of the commission, any due dates for the commission, whether the commission is considered “No Rush” “Priority” “Experimental” etc., what stage the commission is at, the finished commission file with a watermark, and any other small details added to the description.- Commission stages advance from left to right of Trello and include “Waitlist” “Not Started” “Visual Problem Solving” “Clean up and Render” “Finishing Touches and Export” and “Done”.- Progress Checklists may be included in the commission tracking post, but are not guaranteed.- Work in progress files will not be posted on Trello.- Work in progress files will be given to the client as frequently as necessary, and when the client requests.- Changes in the commission are not always linear or guaranteed between work in progress requests made by the client.Edits- What is considered a major or small edit is decided at the discretion of the artist within reason.- If the commission has reached the “Clean up and Render” stage or beyond as shown on Trello the client may request any reasonable amount of small edits. However, if the client requests any major edits/changes, editing fees may apply.- Editing fee costs are negotiated between the artist and client depending on the exact details of the major edit request.- If the commission has reached the “Finishing Touches and Export” stage as shown on Trello, the client may only request up to 3 small edits.- Once the client has confirmed that the artwork is to their satisfaction or the client has run out of edits, the commission is considered finished.- Once a commission is finished, the artist is not required to make any more edits on the commissioned artwork, however, the client may still request small edits, but those edits are not guaranteed.Delivery and Availability of Files- The client will be sent a high resolution file of their commission without a watermark.- File types other than .png .jpg .gif .mp4 and/or .mov must be requested by the client and possible for the artist to export as.- Files will be shared via file storage sites Google Drive or Dropbox.- Files are required by the artist to be made available to the client via the file storage site for 30 days once the commission is delivered to the client.- The files may be made available longer than 30 days for however long the artist wishes.- The artist is not required to continue making the files available to the client after 30 days.- It is the client’s responsibility to download and backup the files into their own file storage system within 30 days of the commission being shared with them.- If the files are no longer accessible to the client and the client has lost the files on their own file storage system or have forgotten to download and backup the files, the client may contact the artist and request for files to be made accessible for another 30 days after the request is sent. This request can only be made once. The re-availability of the files is not guaranteed and the client may not be able to receive the files.Copyright and Usage Rights- The client must be the copyright holder or have documented legal permission from the copyright holder of the character/subject to commission artwork of the character/subject. If the client does not have permission, the commission may be rejected.- The artist holds every right to the produced drawing, not the client.Therefore the artist is allowed to use the work to:
✦ Promote the artist’s work and business.
✦ Display the artwork anywhere to the artist’s liking.
✦ Post the artwork wherever the artist wants.
✦ Use the artwork as examples in portfolios and commission examples
✦ Create other content with the art.
Use the artwork for any personal or commercial use.
The client is allowed to:
✦ Claim the design of the character(s) but not the artwork itself.
✦ Share the art on social media with proper credit to NotSoKatt.
✦ Print the art for personal use (such as friends and family gifts or home decoration.)
✦ Use the artwork for any personal use (where it is not possible to profit off the artwork itself or the display of it).
✦ Print and reproduce the art commercially as agreed upon between artist and client with written documentation.
✦ Use the art for any commercial use as agreed upon between artist and client with written documentation.
✦ Use the work in the client’s projects and other works as agreed upon between artist and client with written documentation as well as with proper credit to NotSoKatt
The following is considered Copyright Infringement if done by the client:
✦ Reproducing/using the artwork commercially without the artist's knowledge and consent.
✦ Taking credit for the creation of the artwork.
✦ Using the commissioned artwork in AI datasets.
✦ Editing or repurposing the artwork for projects without the artist's knowledge and consent.
- If the client breaks the copyright in any way, every right the client has to the commissioned work will be revoked and the artist will not accept any future work from that client.Cancelations and Refunds- The artist has the right to cancel a commission at any time for any reason.- If the artist cancels the commission, the client will receive a 100% refund within the next 30 days.- The client may request to cancel their commission before the commission is finished as long as it is approved by the artist.- If the client cancels the commission before any work has begun, the client will receive a 100% refund minus the amount of any credit card or transaction fees within the next 30 days.- If the client cancels the commission after any work has begun, the client will receive a 50% refund within the next 30 days.- Refunds of any kind cannot be made once the commission is finished and sent to the client.- If the commission is canceled by either party, the client will not receive any more files from the artist and the client will not have the right to use any of the work in progress files of the commission in any way.- If the client files a chargeback against the artist, the client's right to use the commissioned artwork in any way will be revoked and the artist will not accept any future work from the client.

What does the process look like?

Terms of Service!
- Before anything, please go over my Commission Terms of Service!! This is all the legal stuff you will be agreeing to when you commission me!!
Contact!
- To start this whole process, first you gotta contact me! You can email me at [email protected]. All you gotta do is say "Hi! I'd like to commission you for XYZ" and I'll be like "Heck ya!! Let's do this!" And I can walk you through step by step from there.
And for all the socially anxious people out there, I am also very very socially anxious, I totally get it lol. You can contact me online however feels most comfortable to you and don't worry if you're not sure what to do/say, I'll ask all the questions I need and always make sure you have the opportunity to bring up any questions/concerns. And I do not mind at all if you'd prefer to talk casually or formally, I am versed in both! :DAlso, there is never any rush to get back to me or send payments or anything, I am always willing to work at whatever pace the client sets! Just know I won't be able to continue any progress on your commission until I get a response/payment and I can find the time to work on your project after your response (so if I end up busy or on vacation or something by the time you respond, it might take me a while to get back to you/start working lol), so if you're in no rush then neither am I!Discuss!
I will ask you a bunch of questions about your project! Some artistic visual problem-solving stuff like: What is the overall scene we are creating, what kind of mood do we want the piece to have, what details do we want to add, what are the character(s) personalities and stories, etc.
As well as some more business-y stuff like: Are you in any kind of rush to get this commission finished, what do you plan on using the art for, is this a project you want to keep private until release, is the price I give you within your budget, etc.And of course, I'll be sure to send to you a link to my TOS and make sure you know that by commissioning me these are the terms you are agreeing to.Pay!
- Once we have all the info we need and a solid idea down of what you're looking for, then I'll send you a link to my Ko-fi (or send you an emailed invoice if you prefer that instead) and you can go ahead and pay the full price we agreed upon. Once it's paid in full I can get to work!
- Please do NOT pay me ANYTHING until I send an invoice or link to my Ko-Fi. If you do I'll probably just refund you the money minus any credit card/transaction fees (So you might lose a few dollars).Check the Progress!
- You can check out the real time progress I make on your commission over on my Trello! It'll have all your commission info, what stage your commission is at, and how much time I've spent on it so far!
Edits!
As I work on the commission I will send work in progress images and ask any questions I might have. This is a very convenient time to request any edits or changes to the commission!
- Just know the longer the commission goes on, the harder it is to change stuff. If you ask for an edit late in the game that feels like a big change after we've already got a lot done, (ie. I have to throw away a bunch of work and start over.) editing fees may apply. If they do, we can talk about it and figure out a plan together!- So it's best to call out stuff you notice as soon as you can! Please don't be afraid to critique my work!! I honestly take no offense for it and just see it as you helping me make the best piece I can!Delivery!
- When you're satisfied with the commission or you run out of final edits to make, I will send you the finished product at full resolution (and any specified resolutions) without any watermarks via Google Drive or Dropbox.
- Please download your files and back them up if you can! I am only required to have your files available for 30 days minimum. After that I can take them down whenever I want in order to save space in my Google Drive/Dropbox. I usually only take down the really really old commission files, but if I took yours down and you forgot to download or you lost your files, you can contact me and I'll probably have it and can send it to you again, no problem!

When and how do I pay?

- I currently only accept USD through Ko-fi or emailed invoice.
- Please pay upfront in full! Once I receive the payment I will begin working on the commission.

When will my commission be done?

- Depending on what kind of commission it is, my schedule, how busy I am, and how many edits you request for the piece, the time it takes for your piece to be finished will vary.
- Usually the lower budget pieces will take a week or so while more complex things can take around a month or more to complete.
- However, if you need a piece to be done by a specific deadline, we can discuss it, and I can assure you it will be finished by the deadline.
- If you need a piece to be finished within two weeks or less of the day you contacted me to commission it, rush fees may apply.

What is a head shot / half body / full body?

These are terms artist use to determine how much of the body is being illustrated in a piece. The more of the body that is drawn, the more that the piece will cost.- Head shots typically show the top of the head to the shoulders/middle of the chest.- Half bodies typically show the top of the head to the waist or hip.- Full bodies just have the entire character drawn, from the top of their head to their shoes.

Do you draw XYZ?

- For commissions I mainly make Digital Illustration, some Emotes, and sometimes character design.
- If you are looking for something not listed on my commission page or want something done for a bigger more long term project, you can check out my contract project page instead!
✓✓✓- I am comfortable drawing gore, some profanity, Humans, Animals, Anthros/Furries, Cartoons/Anime, All body types and races, OCs, People from photos, Dynamic scenes, Machinery, and Color pallets.
✕✕✕ - However I am not comfortable drawing Copyrighted Character/Characters you do not legally have the rights of, Sexual themes, NSFW, Abuse of a person or substance, Fetishes, Exaggerated characteristics that could be fetishized or considered racist/transphobic/fatphobic/ableist, and Discriminatory depictions.
- If I know for a fact the commission is outside of my capabilities or comfort, I will let you know before you pay me.

How can I use my commissioned piece?

- You can use your commissioned art for any personal use or to support the small businesses of sole proprietors and independents. This means you can use your commissioned piece as screensavers, icons, headers, page dolls, emotes, stream alerts, etc. as long as you are not a big business, company, corporation, or entity and you're not directly profiting off my work.
- You may not sell the art itself, sell it on any merchandise, use the art to design merchandise, add the art to an AI dataset, or turn the commissioned art into an NFT without my written consent as commercial fees may apply.
- If you are a larger business, company, corporation or entity, commercial fees will absolutely apply.

Can I get my commission as a print/sticker?

If you plan on selling it or using it for advertising or making a profit off my work in any way, you need to get written permission from me first! And depending on how/what exactly you're selling from my work, commercial fees may apply.However, if you're just printing it for yourself, or making a gift for your friends/family, GO FOR IT. That's so cool!! I'd still love to know that you printed it just cause it makes me feel cool seeing my work existing in other people's real life.

What if I want multiple characters in a single piece?

If you want multiple characters, typically the price will increase by 50% of the original price. However, this varies for different types of work.- For example, a cutout style piece ($25) of two characters (+50% of the Original Price) would be 25+(25×.50)= $37.50

What can be used as a reference?

For character reference I accept reference sheets, other drawings of the same character, your own drawing of the character (even if you think it's sloppy or confusing), and photographs. As long as the design itself is owned by you or you have documented permission that you can commission art of that character!Any references for poses, expressions, general compositions, lighting, color pallets, environments, camera angles, whatever, can be pretty much anything lol, as long as it helps describe what you're going for!

Can I reference a specific art style?

For commissions, eehhh nope. Not really.If it's a style I have posted on my commission page, then heck ya that's the style we're doing. But if you want me to mimic another artist/media's style that I don't have displayed on this site, then sorry :/If you want still want a specific art style, you can check out my skill range in my portfolio for contract projects and see if I make anything similar to what you're looking for. If you're interested in signing a contract with me you can contact me and give examples of the style you're looking for and I'll let you know if it's something I can do!

If you're new to commissioning an artist, don't know exactly what I offer, or just want to make sure you don't miss any info, you can fill out a commission form! This form will take you step by step through every detail we will need. With this form you are free to send me multiple responses, you can submit it and still be able to change your response later if you change your mind before I get back to you, and you can ask me any questions you have directly from it! I will respond to you using the information you provided and we can discuss and confirm the plan for the thing you want!
If you've commissioned me before or know how this goes, then you can simply read through my terms of service before DMing me on Discord or Twitter, or even emailing me at [email protected]. Tell me what idea you have in mind, send me any references if you feel it is necessary, ask me any questions you have. Then I will get back to you as soon as I can and we can discuss it all!

How many edits can be made on a piece?

You are free to make as many edits as you want (within reason) when your commission is still in a rough draft state. But once your commission is completely finished, you can only request 3 minor edits for free, any large edits or extra small edits will have an added fee.

- For services I mainly make Digital Illustration and assets, Traditional animation, 2D puppet animation, Character/Prop concept/design/development, and Environment/Background concept/design/paint.

Costs and Process Summary

After discussing your project and understanding the level of commitment, complexity, or iterations required, I will give you an estimated price expected to be paid by project (not by hourly rate), and we can negotiate from there.Do keep in mind, I'm also willing to work within the budget available, as long as we have well discussed the expectations for both me as the artist and you as the client.

Hihi! I am Katt (They/Any pronouns), a digital artist, animator, and a bunch of other stuff! After officially starting my freelance business in 2021 I've been on a journey with the sole purpose to make cool stuff with cool people!As I grow, I am drawn more and more towards indie games, films, and comics, noticing the most original and bold ideas in media today are all coming from the indie scene. And while you're here, I have a couple personal projects I am currently working on yet to be announced!- This summer me and my friend (and a bunch of other helping hands) are working on an animated short film! It's an action comedy that takes place in a quirky fantasy grocery store, our anxious protagonist just can't make a decision on what to buy and cracks a bit under the pressure. I've already been learning so much on how to communicate and make long term decisions together as co-directors with my friend. It's been a lot of fun and very eye opening!- I am also working on a small game by myself! Using RPGmaker MZ, I am having so much fun putting together a dumb silly story about this little bug named Bigg who falls down a crack in the earth and must solve puzzles, deal with the locals, and fix this great machine, all to get back to his home in New Bugland. This little projects fills me with so much joy, I'm really excited to get some final concepts together to share with everyone!And... ya! I think that is a good summary of where I've been at.----Oh! And just as a quick fun fact, my persona is a little fairy demon guy! Surprisingly not a cat (at least not anymore lol), which a lot of people assume.
